President Trump celebrated a major legal victory on Monday, as special counsel Jack Smith moved to dismiss both of the high-profile federal cases against him. In a statement on his Truth Social platform, Trump called the charges “empty and lawless,” adding that they should never have been filed in the first place. He further pointed out the astronomical cost of these politically motivated attacks, claiming that over $100 million in taxpayer dollars had been wasted in what he described as the Democrat Party’s effort to target their top political opponent.
“These cases are nothing more than a waste of resources,” Trump declared. “The left has used every tool at their disposal to try and bring me down, but it’s clear their efforts are rooted in politics, not justice.”
Smith’s decision to dismiss the two key cases—one related to alleged election interference and the other concerning classified documents—was based on the Department of Justice’s long-standing policy that a sitting president cannot be prosecuted. In the filing, Smith’s team explained that the DOJ determined the constitutional prohibition against indicting a sitting president applied to this situation. This policy was cited in both the January 6th case and the documents case in Florida, effectively ending those criminal cases against Trump before his upcoming inauguration.
While the cases against Trump are being dropped, Smith’s team is continuing with the prosecution of Trump’s two co-defendants, Walt Nauta and Carlos De Oliveira, who face charges related to the Mar-a-Lago documents case. These individuals do not have the same immunity protections as a sitting president.
Trump, who has repeatedly condemned the politically charged nature of these prosecutions, indicated that he would move swiftly to fire Smith upon his inauguration. “If I’m sworn in, he’s out within two seconds,” Trump declared, signaling his commitment to rooting out the political weaponization of the justice system. The dismissal of these cases, while not a complete victory, represents a significant setback for the Biden administration’s efforts to derail Trump’s political future.
