During a tense hearing in Boston on Thursday, U.S. District Judge Indira Talwani said she plans to require the USDA to tap into its contingency reserves to fund Supplemental Nutrition Assistance Program (SNAP) benefits.

“If you don’t have money, you tighten your belt,” Talwani said — before insisting the government still find “an equitable way of reducing benefits.”

Her remarks came as Democratic officials from 25 states and Washington, D.C. sued the federal government to keep the program alive. The lawsuit claims that halting payments this weekend would be “illegal” and could lead to hunger among recipients.


Biden Administration Reluctant to Limit Spending

The USDA has already stated it won’t use more than $5 billion of its $9.2 billion November budget to cover benefits, arguing that the contingency fund was meant for emergencies like natural disasters — not political stand-offs.
