The decision, delivered Monday by U.S. District Judge Dabney Friedrich — a Trump appointee — rejected a lawsuit from liberal activist groups attempting to block the collaboration. These groups had argued that illegal aliens who file tax returns deserve the same privacy protections as U.S. citizens and legal immigrants. Judge Friedrich disagreed, siding with the rule of law and border security.
The lawsuit was sparked by an agreement allowing ICE to cross-check names and addresses of known illegal immigrants against IRS records. This strategic partnership is part of President Trump’s broader mission to restore law and order at the border, prioritize American taxpayers, and remove those who have broken immigration laws.
The IRS has seen internal shakeups over the issue. Former acting commissioner Melanie Krause resigned just weeks ago amid controversy over growing cooperation between the Treasury Department and ICE. Critics within the bureaucracy pushed back — but Trump’s America First policies are moving forward.
According to Judge Friedrich, the IRS is not overstepping its authority. Federal law clearly allows the IRS to share specific information with other agencies if it’s part of a criminal investigation. Importantly, this ruling affirms that taxpayer privacy laws remain intact — full tax returns cannot be disclosed. However, names, addresses, and taxpayer ID numbers can be used by ICE for enforcement purposes.
The Trump administration has defended the agreement as a targeted tool for serious immigration cases — not a blanket policy. Acting ICE leadership says this data-sharing is focused on major criminal violations and national security threats.
Treasury officials say this is about protecting American jobs, enforcing immigration laws, and making sure taxpayer-funded benefits are not abused.
