Democrats Say Trump Violated The Constitution
A group of House Democrats is challenging an executive order signed by President Trump that recognizes only two sexes, claiming that it violates constitutional principles and legal protections. The executive order, which was signed on Trump’s first day in office, instructed federal agencies to cease promoting the idea of gender transition. These Democrats argue that transgender individuals, like all Americans, are entitled to the same legal protections under the Constitution, and they contend that no executive order can overrule federal laws or Supreme Court rulings.
Representatives Mark Takano (D-Calif.), Jamie Raskin (D-Md.), and Gerry Connolly (D-Va.) expressed concern that the language used in Trump’s executive orders and memos targeting the transgender community reflects harmful bias. They argue that such policies create an environment of discrimination and animosity, leading to harmful consequences for those affected. The letter sent by these lawmakers was addressed to the Office of Personnel Management (OPM), urging the agency to stop implementing Executive Order 14168. The order has prompted OPM to issue guidance directing federal agencies to end programs, grants, and contracts that promote or advance gender ideology.
The Democrats are also pushing for the revocation of a memorandum issued by the OPM on January 29, 2025, which outlined how to enforce Trump’s executive order. They called on the OPM to rescind the memo and honor its duty to uphold the Constitution and federal law.
Throughout his campaign, Trump criticized his political opponent, former Vice President Harris, for supporting policies that promote transgender inclusion. Upon taking office, Trump signed several executive orders targeting transgender issues, including measures that banned transgender individuals from participating in women’s sports and limited their ability to serve openly in the military.
For many conservatives, these actions align with the values of protecting biological sex and ensuring fairness, particularly in the context of women’s sports and national defense. Trump’s approach reflects a commitment to defending traditional family values and ensuring that the rights of Americans are protected without compromising established standards.
