A top federal prosecutor in Virginia may refuse to bring mortgage fraud charges against New York Attorney General Letitia James, even as President Donald Trump and millions of Americans demand accountability from what they see as a politically biased legal system.
According to an MSNBC report, Elizabeth Yusi, who oversees major criminal prosecutions in the Eastern District of Virginia, told colleagues she found no probable cause to pursue the case. Yusi is expected to present her findings soon to Acting U.S. Attorney Lindsey Halligan, a former White House legal adviser and Trump ally known for her tough stance on corruption.
Tensions Rise Inside the Justice Department
Yusi’s decision has sparked new tension inside the Department of Justice, where conservatives say too many prosecutors are still protecting Democrat officials while aggressively targeting Trump supporters.
Halligan recently replaced Erik Siebert, who reportedly refused to pursue cases involving James Comey and other former officials accused of misconduct. Upon taking office, Halligan quickly secured Comey’s indictment for lying to Congress and obstructing a congressional inquiry—a move widely praised by Trump supporters.
Now, insiders warn Yusi could face termination if she refuses to move forward against James. The case has become a flashpoint in the broader battle over whether the Justice Department can operate fairly under the current political climate.
Trump: “Letitia James Is SCUM”
President Donald Trump did not hold back. On Truth Social, he blasted James as “SCUM” and accused her of conducting a “WITCH HUNT” against him and other conservatives.
“She should be removed from office immediately,” Trump wrote, calling James’s years-long pursuit of him “a disgrace to the American justice system.”
The President’s comments echo the frustration of millions of conservatives who believe James and her allies have weaponized their offices to punish political opponents instead of serving the people.
Mortgage Fraud Allegations Under Scrutiny
The investigation stems from a criminal referral issued in May by Bill Pulte, director of the Federal Housing Finance Agency (FHFA). Pulte alleged that James falsely claimed a Virginia home—where her niece resides—as her primary residence in order to secure a lower mortgage rate.
James’s attorney, Abbe Lowell, has denied any wrongdoing, insisting that James never made the false claim. He said a clerical error on a power-of-attorney form listed the address incorrectly and that James even emailed her broker stating the property “will not be my primary residence.”
Conservatives Question Equal Justice
The controversy has only deepened America’s distrust in the justice system. Critics argue that Democrats like Letitia James face little scrutiny, while conservative figures are investigated relentlessly over far less.
“The double standard is glaring,” one legal analyst noted. “If this were a Republican attorney general, they’d already be in handcuffs.”
