The lawsuit was assigned to Judge Charles Breyer, a Clinton appointee and brother of retired Supreme Court liberal Stephen Breyer — raising concerns among conservatives about political bias in the judiciary.
Newsom’s lawyers pushed for a ruling by 1 p.m. Tuesday — a rare and aggressive move. Their request? To keep Trump’s troops confined to the immediate vicinity of federal property like the Roybal Federal Building and federal courthouse, where many of the protests have turned chaotic.
DOJ Warns: Blocking the Troops Could Jeopardize Homeland Security
The Department of Justice hit back hard, slamming Newsom’s request as “legally meritless” and “dangerous.” Federal attorneys warned that blocking National Guard support would put DHS agents and ICE officers at risk.
In a strongly worded filing, the DOJ asked the judge to reject Newsom’s motion and give the federal government at least 24 hours to respond — noting that the state’s demand for an ex parte ruling without a hearing was legally unprecedented.
“This is about keeping America safe,” one federal official told reporters. “The President is acting to restore law and order — why is California trying to stop that?”
