DHS Tackles Biden’s Shelved Orders
President Donald Trump is taking bold action to reverse what officials call Joe Biden’s “quiet amnesty” for illegal immigrants—reopening hundreds of thousands of deportation cases that the Biden administration quietly shelved.
Biden’s Policy Left Borders Wide Open
Under Biden, immigration courts were directed to dismiss or “administratively close” cases instead of ruling on them. This allowed illegal immigrants—including convicted criminals—to remain in the U.S. indefinitely without legal status.
DHS data shows the majority of these asylum claims are ultimately ruled invalid, but under Biden, cases were simply removed from the court docket.
“Biden chose to release millions of illegal aliens, including criminals, into the country and delay their cases indefinitely,” said DHS spokeswoman Tricia McLaughlin. “Now, President Trump and Secretary Kristi Noem are following the law, resuming these removal proceedings, and ensuring cases are heard by a judge.”
The Numbers Are Staggering
A 2023 House Judiciary Subcommittee report found that more than 700,000 deportation cases were dismissed, terminated, or closed under Biden and Vice President Kamala Harris. Republicans warn this amounted to an “open borders” policy that endangered American communities.
Cases Reopened—Even Years Later
Trump’s policy shift has shocked many illegal immigrants who thought their cases were permanently closed. According to the Los Angeles Times, individuals like Jesus Adan Rico—a DACA recipient—and Maria Torres, who came to the U.S. at age two and married a U.S. citizen, recently learned their cases are back on the docket.
Immigration Lawyers Overwhelmed
Attorneys nationwide report a flood of government motions to “recalendar” cases—often without explanation—creating a surge of work for immigration courts.
“The court is drowning in these motions,” said Minneapolis attorney David L. Wilson, who has received dozens since late May.
For decades, administrative closures were used to ease court backlogs, giving immigrants time to apply for hardship waivers or other relief. Trump’s DHS argues many still have no legal right to remain and must be removed.
