DOJ Still Investigating Biden?
A federal investigation into the use of an autopen inside the Biden White House is still ongoing, according to multiple sources familiar with the matter.
The update comes after earlier reports suggested the Department of Justice had quietly dropped the probe. However, officials now say the investigation remains active and continues to examine whether senior aides improperly used the device while former President Joe Biden was in office.
DOJ Disputes Report Claiming Probe Was Dropped
A senior Justice Department official told the Washington Examiner that the investigation has not been closed, pushing back against previous reporting from The New York Times suggesting prosecutors had ended the inquiry due to a lack of evidence of criminal wrongdoing.
The official noted that using an autopen itself is not automatically illegal, and such devices have been used by past administrations to sign routine documents.
“I don’t think informed observers believe that the use of an autopen, by itself, breaks the law,” the official said.
However, investigators are focusing on how the device may have been used and who authorized it.
Focus of Investigation Is on Biden White House Staff
According to sources familiar with the probe, investigators are examining whether White House aides could have used an autopen to sign official documents without the president’s direct knowledge or approval.
The inquiry reportedly centers on concerns that staff members may have:
- Authorized executive actions without proper presidential approval
- Bypassed normal decision-making procedures
- Used the device in ways that could conflict with the president’s stated intent
Officials emphasized that the investigation is primarily examining the actions of White House aides, not the former president himself.
Justice Department officials also rejected claims that prosecutors were attempting to determine whether Biden personally committed a crime.
U.S. Attorney Jeanine Pirro Overseeing the Probe
The inquiry is being handled by the office of U.S. Attorney Jeanine Pirro, though officials have declined to provide additional details.
Pirro addressed the matter briefly on social media, stating that her office cannot comment publicly on an active investigation.
Federal investigators have not disclosed how long the inquiry may continue or whether it could lead to any formal findings.
Biden Rejects Claims About Decision-Making
Former President Joe Biden has firmly denied suggestions that others were making decisions on his behalf while he was in office.
In a previous statement, Biden said he personally directed the major actions taken during his presidency.
Biden pushed back on the claims, saying he personally directed the key decisions of his presidency, including pardons, executive orders, legislation, and official proclamations, and dismissed any suggestion otherwise as untrue.
Why the Autopen Investigation Matters
The controversy has sparked broader debate in Washington about presidential authority, transparency, and the role of White House staff in executing official decisions.
While the autopen has been used by multiple administrations over the years, critics argue that its use raises serious questions if staff members were making decisions without the president’s direct involvement.
For now, Justice Department officials say the investigation remains active as they continue reviewing the circumstances surrounding the use of the device during the Biden administration.
Whether the probe ultimately leads to further action remains uncertain, but the issue has already renewed scrutiny over how presidential power is exercised behind the scenes in the White House.
