But according to a top constitutional scholar, the answer is clear: President Trump does not need congressional permission to protect America.

“The Constitution gives the president the power to act quickly and decisively,” said legal expert John Yoo, who helped craft the 2001 post-9/11 Authorization for Use of Military Force (AUMF). “He doesn’t need to wait for Congress when American lives or national security are at risk.”


Congress Divided While Iran Threatens Nuclear War

Both Republicans and Democrats are arguing over their place in the military decision chain. Some demand that Congress should vote before any strike is launched, while others quietly acknowledge that President Trump has the legal authority to join Israel’s air campaign against Iran—especially to stop the Islamic regime from building nuclear weapons.

“The founders of this country didn’t want a slow-moving Congress to paralyze national defense,” Yoo explained. “They empowered the president to defend the nation without delay.”


Double Standards in Washington?

Ironically, lawmakers who opposed Trump’s leadership are the same ones who said nothing when Presidents Obama and Biden launched military actions abroad—without seeking formal approval.

“This isn’t about the Constitution—it’s about politics,” Yoo told Fox News Digital. “When Biden sent billions to Ukraine or Obama bombed Libya, there were no cries for congressional authorization.”


Congress Can Stop It—But They Won’t

Two new resolutions—one in the Senate from Democrat Tim Kaine, and another in the House from Rep. Ro Khanna (D-Calif.) and Rep. Thomas Massie (R-Ky.)—aim to force a congressional vote before Trump could use military force.

But as Yoo points out, Congress already has the ultimate check: the power of the purse.

“If they don’t want Trump to act, all they have to do is stop funding the military. But they won’t, because they know we need a strong military now more than ever,” he said.

Meanwhile, Republicans are pushing Trump’s massive ‘America First’ defense package, which would pour $150 billion into the Pentagon—bolstering our forces as global threats mount.

“You can’t vote to fund the military and then complain about the president using it,” Yoo added.
