A federal judge has just dealt a blow to President Donald Trump’s efforts to restore law and order in California giving Newsom the win he desperately needed.

In a controversial ruling, Judge Charles Breyer—a Clinton appointee—claimed Trump violated the Posse Comitatus Act when he sent in the National Guard and Marines to confront violent anti-ICE riots.

Judge Blocks Trump’s National Guard Deployment

The court ruled that President Trump and Defense Secretary Pete Hegseth went beyond their authority by mobilizing 4,000 National Guard troops and 700 Marines to support federal immigration raids in California. According to Breyer, using soldiers for riot control, arrests, or even traffic stops amounts to an “unlawful militarization of our streets.”

This decision is being hailed by Democrats as a win against Trump’s tough stance on illegal immigration. California’s Governor Gavin Newsom immediately took to social media to celebrate, writing: “Trump LOSES AGAIN.”

What the Ruling Really Means for America

While Breyer’s ruling only applies to California, the implications are much larger. President Trump has warned that he could use the National Guard in other Democrat-run cities like Chicago and Washington, D.C., where violent crime and open-border chaos are spiraling out of control.

In fact, the Ninth Circuit previously recognized that courts must be “highly deferential” to the President when reviewing National Guard deployments.

That makes Breyer’s ruling not only political—but also legally inconsistent.

Governor Newsom and other Democrats cheered the decision, but ordinary Americans see a different picture: violent mobs emboldened, immigration raids stalled, and the President’s constitutional authority under attack.
