A deeply controversial immigration ruling from the Biden administration is now threatening public safety—protecting a convicted murderer and gang member from deportation as legal battles unfold.
In the heart of Los Angeles, now a hotspot for anti-ICE protests and immigration unrest, federal agents from Immigration and Customs Enforcement (ICE) and Homeland Security Investigations (HSI) arrested Alexander Alfredo Palacios Guevara, a Salvadoran national with a violent record including murder and two counts of attempted murder from the 1990s.
Guevara was also previously convicted of sexual abuse of a minor, according to ICE.
When taken into custody, Guevara invoked a Biden-era protection known as CAT – the Convention Against Torture, claiming he faced harm if returned to El Salvador. Records show that on December 18, the Biden-appointed Board of Immigration Appeals granted him DCAT status—a deferral that temporarily shields him from deportation.
Public Outrage Grows Over Biden-Era Immigration Loopholes
“This convicted killer had no business being free in American communities,” an ICE spokesperson told Fox News. “He’s a known member of the Surenos gang, with multiple convictions for violent crimes. This case is a direct result of soft-on-crime immigration policies from the last administration.”
Thanks to leadership under President Donald J. Trump and Secretary Kristi Noem, ICE officials acted swiftly—re-arresting Guevara just one day after his release.
The public safety threat posed by Guevara is forcing the Trump administration to consider third-country deportation, a strategy that has been used in the past with hardened criminals who can’t legally be returned to their home countries.
However, recent rulings by activist judges—including one in **Boston who blocked a similar removal to South Sudan—**have made that path more difficult. The Department of Homeland Security is now pushing for the U.S. Supreme Court to overturn that decision and restore border enforcement authority.

When asked by reporters whether he was guilty of murder, Guevara responded coldly: “I’m free.”
Fox News reached out to Guevara’s immigration attorney for clarification on what threats he allegedly faces in El Salvador—but received no response.
