How State Will Replace Trump’s Newest Pick
President Donald Trump’s decision to nominate Oklahoma Sen. Markwayne Mullin (R-Okla.) to lead the Department of Homeland Security has created a major political opening in Washington — and a temporary vacancy in the U.S. Senate just months before the upcoming midterm elections.
The move means Oklahoma Gov. Kevin Stitt will soon appoint a temporary replacement to fill Mullin’s Senate seat until voters select a permanent successor.
The situation is drawing attention in political circles as Republicans look to maintain strong conservative leadership both in Washington and across the states.
Why Mullin Is Leaving the Senate
President Trump announced Thursday that Mullin will take over leadership of the Department of Homeland Security beginning March 31, replacing former DHS Secretary Kristi Noem.
If confirmed, Mullin will become responsible for overseeing several of the federal government’s most critical agencies, including those responsible for border security, immigration enforcement, and national security operations.
Mullin first entered the U.S. Senate after winning a 2022 special election, following more than a decade representing Oklahoma in the U.S. House of Representatives.
His appointment is seen by many Republicans as part of the Trump administration’s continued focus on strengthening immigration enforcement and protecting the U.S. border.
Oklahoma Law Determines How the Seat Is Filled
Because Mullin will leave the Senate before his term expires, Oklahoma law outlines exactly how the vacancy will be handled.
Under state rules, the governor is allowed to appoint a temporary replacement when a Senate seat becomes unexpectedly vacant. That individual serves until voters elect a new senator during the next statewide general election.
The current process was created by legislation passed in 2021, which sought to avoid the high cost of holding a separate special election immediately after a vacancy occurs.
State Sen. Lonnie Paxton (R), the bill’s sponsor, said when the measure was introduced that its purpose was to spare taxpayers the burden of paying for what he called an “extremely expensive and inconvenient” special election.
The system ensures Oklahoma continues to have full representation in the U.S. Senate while still allowing voters to ultimately choose the long-term replacement.
Strict Rules for the Governor’s Appointment
The law also places clear restrictions on who can be appointed to the seat.
To qualify, the temporary senator must:
- Be a registered voter in Oklahoma
- Belong to the same political party as the departing senator for at least five years
- Not run in the next special election or general election for the seat
Those restrictions were designed to prevent the temporary appointee from gaining the political advantage that often comes with incumbency.
“We established specific eligibility guidelines for the appointment,” Paxton said when the bill passed.
“The person filling the role is meant to be a temporary placeholder so Oklahoma is not underrepresented in the U.S. Senate.”
Gov. Kevin Stitt Praises Mullin Appointment
Oklahoma Gov. Kevin Stitt quickly welcomed President Trump’s decision to elevate Mullin to the Department of Homeland Security.
Stitt described the Oklahoma senator as a strong conservative leader who will bring practical experience to the role.
“There isn’t a better choice to lead the Department of Homeland Security,” Stitt wrote on the social media platform X.
“Oklahoma has shown the rest of the country how effective immigration enforcement can be done, and Markwayne will carry that same practical, common-sense approach to the Department of Homeland Security.”
Focus Turns to Who Will Replace Mullin
With Mullin expected to leave the Senate at the end of March, attention is now turning to who Gov. Stitt might appoint as the temporary replacement.
While the governor has not announced any specific candidates yet, he has already outlined the type of person he wants to send to Washington.
Stitt said he is looking for a “strong, small-government conservative voice” who will support the Trump administration and defend Oklahoma’s values.
The appointed senator would serve only until voters select a permanent replacement during the November general election.
Oklahoma Senate Race Will Begin Soon
The race to fill the seat permanently could begin quickly.
According to the Oklahoma State Election Board, the official filing period for federal candidates runs April 1 through April 3, marking the start of what could become one of the state’s most closely watched political contests this year.
For now, however, the immediate decision rests with Gov. Stitt — who must choose a temporary senator to represent Oklahoma in Washington while the state prepares for the next election.
