Supreme Court Justices Question the Limits of Presidential Power
During a nearly three-hour hearing, several justices, including Chief Justice John Roberts, Amy Coney Barrett, Neil Gorsuch, and Sonia Sotomayor, raised questions about how broadly the president could use such authority.
Roberts noted that the law could give the White House power to impose tariffs “on any product, from any country, for any amount, for any length of time.”
But Lutnick says those concerns overlook a crucial point: the Constitution gives the president broad powers during national emergencies, especially when America’s economy and national security are on the line.

Earlier this year, lower courts ruled that IEEPA doesn’t grant such tariff authority to the president.
