Federal Judges Targets Trump Ally

A new legal battle has erupted in New Jersey, targeting one of President Trump’s strongest allies, attorney Alina Habba. A federal judge has ruled that Habba was unlawfully serving as the state’s top federal prosecutor — a decision that many conservatives see as yet another attempt by activist judges to undermine Trump’s team.


Judge Sides Against Habba

U.S. District Judge Matthew Brann issued a 77-page ruling claiming Habba’s appointment as U.S. attorney for New Jersey was invalid. He argued the Trump administration used “unprecedented personnel moves” to keep Habba in her role after her 120-day interim term expired.

Brann wrote that, after reviewing whether Ms. Habba was legally carrying out the duties of U.S. attorney, he determined she was not.

The ruling temporarily weakens Trump’s legal team in a state long dominated by Democrats.


Democrats Move Quickly Against Habba

The challenge came from defense attorneys for two men charged with federal drug trafficking, who argued Habba had no authority to prosecute once her interim term expired.

When Habba’s time ran out last month, New Jersey’s federal judges — many appointed under Democrat administrations — refused to extend her leadership. Instead, they tried to install their own pick, Desiree Leigh Grace.

But Attorney General Pam Bondi intervened, firing Grace and blasting the judges as “politically motivated” for blocking Habba.


Trump’s Strategy to Keep Habba in Place

President Trump, determined to keep Habba in her post, withdrew her formal nomination and instead made her “first assistant U.S. attorney,” a legal workaround that allowed her to act as U.S. attorney.

But Judge Brann struck down that move, declaring it unlawful:

“Ms. Habba was ineligible to assume the functions and duties … because she was not the first assistant when the vacancy occurred,” he wrote.

For now, the ruling is on hold pending appeal, meaning this fight is far from finished.


Why Habba is a Target

Habba has already made enemies in Democratic circles. During her short time as U.S. attorney, she pursued charges against two Democrat officials for misconduct at a federal immigration facility — a bold move that angered the Left but earned her praise from conservatives demanding accountability.

Unsurprisingly, Sen. Cory Booker and Rep. Andy Kim, both Democrats from New Jersey, strongly opposed her nomination. Their opposition makes it clear: Habba is being targeted because she refuses to bow to the political establishment.


The Bigger Picture

This battle is about more than one attorney. It’s about whether conservatives will be allowed to hold powerful legal positions in deep-blue states without being sabotaged by activist judges and Democrat politicians.
