U.S. District Judge Wendy Beetlestone declined to dismiss the lawsuit, stating that Trump’s statements about the case could be “objectively determined” to be false. “This is yet another meritless and politically motivated attack on President Trump,” Sweigart said in a public statement. “We view the dismissal of several claims as a victory and will continue to defend the President’s First Amendment rights—and by extension, the rights of all Americans to speak freely about issues of crime, justice, and public safety.”
The judge dismissed the claim of intentional emotional distress, offering some relief to Trump’s legal defense. However, the defamation allegation remains, and the case will proceed.
