The notice, obtained by Fox News, specifically cites the Maine Department of Education’s failure to ensure “equal opportunities” for female athletes by allowing biological males to compete in female athletic events, both now and in the future.

The notice warns that if Maine does not rectify these violations, the matter could be referred to the Department of Justice. This action is part of a broader conflict between President Donald Trump and Maine’s Democrat Governor, Janet Mills, over the state’s refusal to comply with Trump’s executive order. The order mandates that biological males be excluded from competing in women’s sports, a policy that has sparked nationwide debate.

Maine has become a focal point in the national debate over transgender athletes’ participation in women’s sports, especially after State Representative Laurel Libby publicly highlighted a trans athlete who won a girls’ pole vault competition in February. Libby warned that if Maine’s Democrats continued to allow biological males to compete in female sports, the state could lose hundreds of millions of dollars in federal funding. She urged Governor Mills and legislative Democrats to reconsider their stance to avoid jeopardizing federal funds and to restore fairness for female athletes in Maine.

In response, Mills’ office threatened legal action if federal funding were withheld, and tensions escalated when the two sides exchanged sharp words during a bipartisan governors’ meeting at the White House. Just hours after the meeting, the Department of Education launched an investigation into Maine’s Title IX compliance, further intensifying the dispute.

This controversy has sparked protests, including the “March Against Mills,” where female athletes voiced their opposition to the governor’s position. Meanwhile, pro-transgender activists organized protests outside Libby’s home, signaling the deeply polarized nature of this debate.

President Trump reaffirmed his commitment to punishing states that continue to allow transgender athletes to compete in women’s sports during a joint address to Congress, stressing that this policy aligns with the values of the American people. White House Press Secretary Karoline Leavitt emphasized that Trump would not back down from this issue, noting that the majority of Americans, including a significant number of Democrats, oppose allowing men to compete in women’s sports.
