Former President Joe Biden has launched a new legal battle against the Department of Justice, sparking fresh criticism from President Donald Trump and raising new questions about transparency surrounding the classified documents investigation that dominated headlines during the 2024 election cycle.
On Tuesday, Biden filed a lawsuit seeking to prevent the release of audio recordings and transcripts connected to Special Counsel Robert Hur’s investigation into Biden’s handling of classified materials from his years in public office.
President Trump quickly reacted on Truth Social, sharply criticizing Biden while sharing reports about the lawsuit.
The case centers around interviews Biden gave during Hur’s investigation, including conversations with author Mark Zwonitzer, who worked with Biden on his memoirs years earlier. According to court filings, Biden’s legal team argues that releasing the recordings would violate personal privacy protections and expose private conversations that took place inside his home.
Biden’s attorneys also stated that the Department of Justice has a responsibility to protect sensitive material gathered during criminal investigations.
The recordings became a major political issue after Special Counsel Hur released his widely discussed report examining Biden’s retention of classified documents from his time as a senator and vice president. Although Hur declined to recommend criminal charges, the report generated national debate after it raised concerns about Biden’s memory and ability to recall certain details during questioning.
Republicans have continued to argue that Biden received more favorable treatment from federal investigators than President Trump did in his own classified documents case. Democrats, meanwhile, have pointed to Biden’s cooperation with investigators as an important distinction between the two cases.
The controversy intensified last year when House Republicans voted to hold then-Attorney General Merrick Garland in contempt of Congress after the Justice Department refused to release the audio recordings. At the time, the White House asserted executive privilege to block the tapes from becoming public.
Written transcripts from Biden’s interviews were eventually released and drew widespread attention after showing moments where the former president struggled to recall certain dates, timelines, and details connected to the documents investigation.
Now, Biden’s latest legal move is reigniting debate in Washington over government transparency, executive privilege, and whether federal investigators applied the same standards equally in high-profile political cases.
