Democrats Attack Trump Over Reflecting Pool Case
Democrats are sharply criticizing the Trump administration after the Justice Department dismissed criminal charges against former Olympic canoeist David Hearn in the closely watched Lincoln Memorial Reflecting Pool case. The decision has reignited debate over the Justice Department’s handling of high-profile prosecutions and sparked a new round of political attacks ahead of the 2026 midterm elections.
Federal prosecutors announced Friday that they were dropping a felony property destruction charge against Hearn after concluding the damage to the Reflecting Pool’s protective liner was linked to construction and installation issues rather than intentional vandalism. Court filings stated that problems with the pool’s lining stemmed from flaws in the original installation, leading the Justice Department to end its case.
The Trump administration, however, continues to dispute that conclusion. Administration officials have maintained that vandalism played a role in damaging the historic landmark and argue that protecting America’s national monuments remains a top priority.
Justice Department Ends High-Profile Case
The case drew national attention earlier this month when prosecutors accused Hearn, a three-time Olympic canoeist, of intentionally damaging approximately two square feet of the Reflecting Pool’s liner. Hearn pleaded not guilty and consistently maintained that he left the site in the same condition in which he found it.
After reviewing additional evidence, the Justice Department determined the damage cited in the indictment was not caused by criminal conduct but instead resulted from construction defects and problems with the pool’s installation. Democrats Renew Their Criticism

Illinois Gov. JB Pritzker said the dismissal represented another setback for President Donald Trump, arguing the administration pursued charges against someone who ultimately should not have faced prosecution.
Sen. Richard Blumenthal of Connecticut also weighed in, saying Americans who are wrongfully prosecuted deserve meaningful legal remedies if federal officials improperly target them.
Rep. Ted Lieu of California directed much of his criticism toward Interior Secretary Doug Burgum, who has continued defending the administration’s position that acts of vandalism damaged the Reflecting Pool. Lieu argued that the Justice Department’s court filings contradicted those claims and questioned the administration’s handling of the investigation.
In a separate statement, Lieu also alleged the prosecution was politically motivated and suggested the controversy could influence voters as the midterm elections draw closer.
Trump Administration Stands By Its Position
Despite the Justice Department’s decision to dismiss the case, the Trump administration has not backed away from its broader position regarding the Reflecting Pool.
Interior Secretary Doug Burgum has continued to argue that repeated acts of vandalism have harmed the historic landmark over time and has emphasized the administration’s commitment to preserving America’s monuments and public memorials. Administration officials have also stressed that protecting national treasures remains an important part of President Trump’s broader efforts to restore and maintain federal landmarks.
The disagreement highlights the difference between the Justice Department’s legal determination in Hearn’s individual case and the administration’s broader view that vandalism has contributed to damage at the Reflecting Pool over the years.

Although the charges against David Hearn have been dismissed, the political battle surrounding the case is far from over.
Democrats are using the Justice Department’s decision to renew accusations that the administration has politicized federal law enforcement, while the Trump administration continues to defend its record on protecting historic monuments and public property.
